Trump Administration Wins Supreme Court Stay Blocking FCC Ad-Rate Deadline
The Supreme Court on Wednesday, Oct. 14, 2026, granted the Trump administration's request for a stay pausing a 4th Circuit order that had told the FCC to decide, within 48 hours, whether party committees and joint fundraising committees qualify for candidates' discounted "lowest unit charge" political ad rates. The 4th Circuit, ruling for four Democratic candidates who sued after the FCC's Media Bureau extended the rate to party committees, had called the relevant statute "unambiguous" in restricting the discount to candidates themselves. The vote was 7-2, with Justices Sonia Sotomayor and Ketanji Brown Jackson dissenting.
The unsigned order reasoned that the tight deadline interfered with the FCC's deliberative process and raised separation-of-powers concerns, and that a rushed decision would cause irreparable harm. The stay leaves party and joint committees with the favorable ad rates in place through the Nov. 3 election, without a final resolution of the underlying statutory question.
The stay is an interim measure that remains in effect while the parties pursue further Supreme Court review; it is not a ruling on the merits. The Court had already issued a temporary stay on Sept. 4, with Jackson dissenting.

Legal outcome: Supreme Court granted an interim stay (7-2) pausing the 4th Circuit's order pending further review; this is not a final ruling on the merits of the FCC's ad-rate interpretation.
