Supreme Court Refuses to Let the Postal Service Enforce Trump's Mail-Ballot Rule for the Midterms

The Supreme Court on Sept. 14, 2026 denied the administration's application in USPS v. California to stay Judge Indira Talwani's Sept. 4 preliminary injunction against the Postal Service's August 2026 ballot-mail rule. Justices Alito and Thomas dissented; Justice Kavanaugh concurred on Administrative Procedure Act grounds.

The denial leaves the injunction in effect for the Nov. 3 elections. It is an interim order on an emergency application, not a ruling on whether the rule is lawful.
Legal outcome: Stay denied in USPS v. California; Judge Indira Talwani's Sept. 4, 2026 preliminary injunction against the August 2026 ballot-mail rule remains in effect for the Nov. 3 elections.
