Mahmoud Khalil Asks Supreme Court to Curb Fast-Track Deportations Over Speech

Columbia graduate Mahmoud Khalil asked the Supreme Court on October 19, 2026, to review how lower courts handled his immigration case, arguing they wrongly limited judges' ability to quickly reverse what he calls unlawful detention. Khalil, a legal permanent resident and prominent pro-Palestinian campus activist, was detained in 2025 after Secretary of State Marco Rubio determined his presence undermined U.S. foreign policy; he was later released on bail while his removal case continues. His petition asks the justices to clarify how fast federal judges must be allowed to act when the government detains someone over speech-related conduct.

The case tests how much latitude courts retain to check executive immigration decisions once the government invokes foreign-policy or national-security justifications, a question with consequences well beyond Khalil's individual case for other noncitizens targeted over political speech or activism.

The petition is pending; the Supreme Court has not said whether it will hear the case. Khalil remains free under the lower court's bail order while the appeal proceeds.
