Justice Department Files Its First Lawsuit Against a School District Over Transgender Student Guidance, Putting $70 Million at Risk

The Justice Department's Civil Rights Division, joined by the U.S. Attorney for the District of Kansas, sued Kansas City, Kansas Public Schools on Sept. 1, 2026, in what the department called a first-of-its-kind case. The complaint alleges the district's internal guidance for transgender and gender-nonconforming students directs staff to implement gender "transitioning" plans without parental knowledge or consent, violating the Family Educational Rights and Privacy Act and the Protection of Pupil Rights Amendment. The suit seeks an injunction halting the guideline. NBC News reported the 21,000-student district could lose nearly $70 million in federal funding.

The case extends federal enforcement of parental-rights statutes into district policy on gender identity, an area historically left to states and school boards. Assistant Attorney General Harmeet Dhillon said the department "will not tolerate school districts playing fast and loose with federal law"; Education Secretary Linda McMahon said the laws are being enforced "at an unprecedented scale."

The district said it has cooperated fully with federal law, is "disappointed" by the filing and will respond in court. Superintendent Anna Stubblefield previously said she could not recall the district withholding such information and that the document is guidance, not policy.
