Class-Action Ruling Restores a Nationwide Block on Birthright Order

After the Supreme Court limited the availability of universal (nationwide) injunctions without ruling on the underlying birthright-citizenship question, a federal judge certified a class of affected children and again blocked the administration's birthright-citizenship executive order on a nationwide basis, this time through the class-action mechanism.

The ruling illustrated how litigants adapted to the Supreme Court's narrowing of universal injunctions, using certified class actions to achieve similarly broad relief, and underscored continuing judicial resistance to the birthright-citizenship order under ordinary procedural tools.

A nationwide class-wide injunction was entered, again blocking enforcement of the birthright-citizenship order.
