Abrego Garcia Is Flown Back From El Salvador — and Charged With Human Smuggling the Same Day

On June 6, 2025, the Trump administration returned Kilmar Armando Abrego Garcia to the United States from El Salvador, nearly three months after deporting him in what the government had earlier called an administrative error. He arrived not as a released detainee but as a criminal defendant: a federal grand jury in the Middle District of Tennessee had returned a sealed two-count indictment on May 21 charging conspiracy to transport people unlawfully present in the United States for financial gain, and unlawful transportation. Prosecutors alleged more than 100 smuggling trips between Texas and Maryland from 2016 to 2025. Attorney General Pam Bondi announced the return, said 'this is what American justice looks like,' and thanked Salvadoran President Nayib Bukele. Abrego Garcia's lawyer replied that 'due process means the chance to defend yourself before you're punished, not after.'

The sequence matters because the Supreme Court had ruled 9-0 on April 10 that the government must facilitate his return, and the administration had spent weeks telling courts it lacked the means to do so. His return under indictment demonstrated the capability existed while converting a civil-removal dispute into a criminal prosecution.

Abrego Garcia pleaded not guilty in Nashville on June 13, 2025.
